1. Acceptance of Terms

By accessing and using FundMe.Link ("the Service", "we", "us", or "our"), you ("User", "you", or "your") accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

FundMe.Link is a platform that enables content creators to:

• Create custom landing pages with unique URLs
• Host and share content (text, images, videos, downloadable files)
• Receive direct donations from supporters via PayPal

Important: FundMe.Link does not process, hold, or transmit payments. All donations are peer-to-peer transactions processed directly through PayPal between the donor and the creator. We are not a party to these transactions.

3. Account Registration and Eligibility

To use certain features of the Service, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Provide a valid email address
• Provide a valid PayPal account email to receive donations
• Comply with all applicable laws and regulations

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. User Content and Conduct

4.1 Content Ownership

You retain all rights to content you upload. By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of operating the Service.

4.2 Prohibited Content and Activities

You agree NOT to use the Service to:

• Upload or distribute content you do not have the right to use
• Infringe upon intellectual property rights, including copyrights, trademarks, or patents
• Distribute illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Engage in fraudulent activities or solicit donations under false pretenses
• Distribute malware, viruses, or any harmful code
• Spam, phish, or engage in any deceptive practices
• Violate any applicable local, state, national, or international law
• Promote illegal activities, violence, discrimination, or hate speech

5. Payments, Fees, and Refunds

5.1 Platform Fees

FundMe.Link charges the following fees:

• Random 6-character links: Free forever
• Custom page names: One-time fee of $1.00 USD (includes 6,000 hosting credits)
• Hosting credits: 1 credit per page visitor; top-ups available at $5.00 for 5,000 credits

5.2 Donations

100% of donations go directly to the creator's PayPal account. FundMe.Link does not take any percentage of donations. Donations are voluntary and non-refundable. Refund requests must be directed to the creator or handled through PayPal's dispute resolution system.

5.3 No Refunds on Platform Fees

All platform fees (custom page names, credit top-ups) are final and non-refundable.

5.4 Tax Responsibilities

You are solely responsible for determining and paying any applicable taxes on donations you receive. FundMe.Link does not provide tax advice or reporting.

6. PayPal Integration

By using FundMe.Link, you acknowledge and agree that:

• All payment processing is handled exclusively by PayPal
• You must comply with PayPal's Terms of Service and Acceptable Use Policy
• FundMe.Link is not responsible for any issues with your PayPal account
• We do not store PayPal credentials or have access to your PayPal funds
• Disputes regarding donations must be resolved through PayPal's resolution center

7. Intellectual Property

The FundMe.Link name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FundMe.Link. You must not use such marks without our prior written permission.

8. DMCA and Copyright Infringement

We respect intellectual property rights. If you believe content on our platform infringes your copyright, please contact us at [email protected] with:

• Description of the copyrighted work claimed to have been infringed
• URL or location of the allegedly infringing content
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

9. Termination and Suspension

We reserve the right to:

• Suspend or terminate your account immediately for violation of these Terms
• Remove any content that violates these Terms or applicable laws
• Suspend pages that run out of hosting credits
• Refuse service to anyone for any reason at any time

Upon termination, your right to use the Service will immediately cease. Fees paid are non-refundable upon termination.

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDME.LINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

• Your use or inability to use the Service
• Unauthorized access to your account or content
• Errors, mistakes, or inaccuracies in content
• Donation disputes between creators and donors
• Issues with PayPal or third-party services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless FundMe.Link and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution
